Cool Cloud Vapor had marketed its e-liquid product as a supplement and a sports drink. These promises were misleading, the FDA claims, because no FDA regulatory requirements or laws exist to regulate health supplements and sports drinks. The company’s application for a non-prescription marketplace distribution label particularly stated that the product could possibly be used as a dietary supplement.
